Managing Director, State Forest Corporation, J&K and others including the beneficiaries booked by Vigilance for illegal appointments
Vigilance organization booked MD State Forest Corporation, J&K and others for abuse of the official position and making illegal appointments in league with the beneficiaries.
A verification was conducted by Vigilance Organization Jammu into the allegations owing to a written complaint lodge by one Dr. Rehmatullah wherein it was alleged that MD State Forest Corporation and others have made 212 backdoor appointments in different cadres of State Forest Corporation besides some persons who were not even state subject have also been appointed/engaged.
During the course of Verification it was revealed that 06 Timber Sorters namely Mushtaq Ahmed Mir, Ram Chand Gopal Sumberia, Naresh Kumar, Shakeel Ahmed Khan and Bashir Ahmed Pandit were illegally engaged vide Order dated 26.04.2010 and one Timber Sorter namely Brij Mohan was illegally engaged vide Order dated 13.11.2010 whereas, 02 Computer Operators namely Ruksana Bano and Ashwani Pardhan wereillegally engaged on 26.05.2010 after seeking approval from the Hon’ble Minister. Further, 09 Computer Operators namely Waseem Ahmed Mala, Amir Azad Khan, Sajad Rasool War, Shabnam Manzoor, SurinderSawhney, Mrs. Suman, Sartaj Manzoor, Asia Afzal, Shazia Nazir and Kounser Jan were also appointed vide Order dated 30.08.2010 after seeking approval from the then Hon’ble Forest Minister as Chairman. Verification has further revealed that in addition to the above illegal engagements/appointments, some non-state subjects were also engaged as watch and ward/chowkidars on consolidated wages. The aforementioned appointments/engagements were made by Abdul Qayoom Khan, the then Managing Director, SFC J&K with the approval of Chairman SFC i.e. the then Hon’ble Forest Minister on pick and choose basis and without putting the said posts to any advertisement and without any competition, in gross violation of rules laid down for such appointments/engagements in the corporation thereby ignoring the deserving/meritorious candidates. By acting in this manner Shri Abdul Qayoom Khan the then MD SFC J&K with the approval of the then Chairman SFC, by abuse of the official position and in league with the beneficiaries conferred undue benefit upon these illegal appointees/engages (beneficiaries).
As the acts of omissions and commissions on the part of Sh. Abdul Qayoom Khan, the then Managing Director, State Forest Corporation, J&K and others including beneficiaries, prima facie, constituted offences punishable U/S 5 (1) (d) read with section 5 (2) J&K PC Act and section 120-B RPC. Accordingly a case has been registered in the Police Station Vigilance Organization Jammu for investigation.
