4 booked for criminal trespass

Acting on a complaint lodged by Alamjit Singh, a resident of Mohali, the police here on Friday registered a case against four persons under Sections 341 (Punishment for wrongful restraint), 447 (Punishment for criminal trespass), 511 (Punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment), 148 (Rioting, armed with deadly weapon) and 149 (Every member of unlawful assembly guilty of offence committed in prosecution of common object) of the IPC.

As per the FIR, the complainant had alleged that he struck a deal for 36 bighas land at Singhpura village, near Zirakpur, on February 2, 2004, for which he paid Rs 37.5 lakh as a token money to the accused.

The complainant further alleged that as per the deal, the other party failed to turn up on June 25, 2004, date fixed for the registry of the land. He said, “I deposited the token money in the SBI treasury to mark my presence on the day of registry.” A few days later, the complainant filed a writ in the Dera Bassi court against the other party for failing to turn up on the date fixed for registry and the decision came in his favour on May 1, 2013.

As per the FIR copy, the other party also filed an appeal against the decision in the Mohali Sessions Court. Later on, the other party filed another appeal in the Punjab and Haryana High Court. The complainant said in both the above cases, the decision came in his favour. He was asked by the court to deposit rest of the amount in the treasury account and get the registry of the land done.
Alamjit further alleged that when he came to take possession of the land on the Supreme Court orders, other party members, including Jalseen Randhawa, Tejinder Singh Randhawa, Goldy, Chamkaur and three to four unidentified persons apprehended him and his workers and started hurling abuses at them. The accused also threatened them with dire consequences, he added.

The complainant alleged that he was apprehended by the accused when he went to take possession of 36 bighas of land at Singhpura village along with his workers.
