Buffalo yet to be found, HC denies bail to man

The Punjab and Haryana High Court has denied anticipatory bail to a man on the ground that a buffalo was to be recovered from him. He was booked for criminal breach of trust for taking the buffalo away from the complainant’s wife after telling a lie.

“Keeping in view the facts and circumstances of the present case and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail,” Justice Inderjit Singh said.

The petitioner, Raj Kumar, had moved the High Court against the state of Haryana for the grant of anticipatory bail in a case registered under Section 406 of the IPC at Badhra police station in Charkhi Dadri district on July 31.

Referring to the record, Justice Inderjit Singh asserted that the FIR in the present case was registered by complainant Vikram, who stated that he was away from house. The accused-petitioner came to his house in his absence. After telling a lie to his wife, he took way the buffalo by playing a fraud.

“A perusal of the record shows that the buffalo is still to be recovered. Hence, the petitioner is required for custodial interrogation,” Justice Inderjit Singh observed before dismissing the bail plea after finding no merit in it.
